1. Sale and Purchase of Goods

Bhimji Sarees Pvt. Ltd. (“Seller”), the parent company of Nargis Fashion, agrees to sell, and you (“Buyer”) agree to purchase, goods described and specified at the checkout window (“Checkout”) in accordance with the terms and conditions set forth in this Agreement.

2. Purchase Price

Buyer agrees to pay the purchase price of the goods as displayed on this website. The purchase price is attached hereto and forms an integral part of this Agreement.

3. Payment Terms

The total purchase price shall be payable in full by Buyer according to the payment due date stated at Checkout. Seller reserves the right to pursue any legal remedies available and is entitled to reimbursement from Buyer for any collection costs, including attorney fees, legal fees, and other associated costs.

4. Delivery

Unless otherwise agreed in writing, delivery shall be made in accordance with Seller’s shipping policy in effect on the date of shipment. Delivery dates provided by Seller are estimates only. Seller shall not be held liable for any delays in delivery. Goods shall be packaged according to Seller’s standard practices unless otherwise agreed in writing.

5. Customs, Duties, and Taxes

The recipient is responsible for ensuring that the product can be lawfully imported into the destination country. Orders shipped to countries outside of India may be subject to import taxes, customs duties, and fees levied by the destination country.

All shipments are currently sent as Delivery Duty Paid, meaning you are not required to pay any duty or taxes upon receiving your shipment.
In the exceptional event that duties or taxes are levied on your parcel, please contact us, and we will assist in resolving the matter.

Customs clearance procedures may cause delays beyond our original delivery estimates. Recipients must comply with all laws and regulations of the destination country and provide necessary documents (social security number, tax ID, etc.) if required.

6. Disclaimer of Warranty / Limitation of Liability

Seller assumes no responsibility for the quality or fitness of the goods for any particular purpose, except as otherwise provided in this Agreement. Seller disclaims all other warranties and conditions, whether express or implied.

7. Color Disclaimer

The colors of products displayed on your computer screen may vary slightly from the actual product. Variations may occur due to differences in monitor technology, fabric texture, and lighting used during product photography.

8. Price Disclaimer

While Nargis Fashion makes every effort to ensure accurate product descriptions and pricing, in the event of a pricing error, Nargis Fashion reserves the right to refuse the sale of the item.

9. Force Majeure

Seller shall not be held liable for failure to deliver goods timely due to factors beyond Seller’s control, including but not limited to governmental action, labor disputes, fire, natural disasters, or other acts of God.

10. General

• Buyer may not assign this Agreement without the written consent of Seller.
• Seller is the sole intended beneficiary of this Agreement.
• In the event of any inconsistency between this Agreement and any other agreement relating to the goods, this Agreement shall prevail.
• This Agreement may not be modified, altered, or amended without the written agreement of Seller.
• Any additional or altered terms attached to an order submitted by Buyer shall be null and void unless expressly agreed to in writing by Seller.
• If any provision of this Agreement is found to be illegal or unenforceable, the remaining provisions shall remain in full force and effect.
• This Agreement shall be governed by the laws of Delhi, India, without regard to conflicts-of-law principles.
• In the event of a dispute, Buyer consents to the exclusive jurisdiction and venue of the courts in Delhi and waives any objections to such jurisdiction and venue.
